E-3 Australian Professional

  • • Only for Australian citizens
  • • Job is a professional position
  • • Employer sponsored
  • • Prevailing wage must be paid
  • • Employee must be a professional
  • • No petition filing in U.S. is required for the consul to issue the visa
  • • Valid for two years

The E-3 visa combines some aspects of an H-1B and the procedure of an E-2 visa.

Note: There is no premium processing (expedite) procedure for change of status permitted by the USCIS. Thus, it is usually faster to apply at a consul for an E-3 visa.

Steps for Obtaining an E-3 Visa

  • Step 1

Lawler & Lawler will send the company and visa applicant a questionnaire. We will analyze the job and foreign national’s credentials to determine eligibility.

  • Step 2

    We obtain prevailing wage verification.

  • Step 3

We obtain the Labor Condition Application from the Department of Labor.

  • Step 4

Working with the employer and foreign national we assist the employer with a supporting letter and prepare, assemble and file the application with consul or USCIS office in the U.S. to change status.

  • Step 5

Applicant is admitted to the U.S. with an I-94 issued by the immigration inspector, or is granted change of status.
