USCIS Stakeholder Call

The February 3, 2016 EB-5 Stakeholder call revealed little new information.

USCIS reiterated that random unannounced site visits will be made to Regional Centers to verify they are in existence and doing business. We see this in other visa areas including employers of H-1B technology workers and religious organizations that sponsor religious workers for R visas (actually, they must have a site visit before an R visa petition is decided).

USCIS also said that some I-829 applicants will be interviewed. In response to a question, USCIS said a representative of the Regional Center may appear with the applicant to answer questions about the project and job creation, which is the principal issue of an I-829.

The next Stakeholder engagement is scheduled for April 25.
