USCIS Proposes to Radically Increase Filing Fees

Tomorrow, the Department of Homeland Security will publish a proposed rule to increase USCIS EB-5 filing fees as follows:

  • I-526s would go from $1,500 to $3,675;
  • I-924s (for a new RC designation, and presumably amendment applications including an “exemplar” application for a new project) would go from $6,230 to $17,795;
  • I-924A RC annual reports would have a new fee of $3,035; and
  • I-829s would remain the same.

Presumably the new fees will cover the costs of performing site visits and audits recently announced by USCIS and discussed in my last newsletter. USCIS must take in comments from the public and thus it may take a few months to enact the new fees.
